What Makes Military Divorce So Complex?

Some of the reasons for the complexity of military divorce are obvious. For example, when a parent is stationed outside of Texas or overseas, it makes coming up with child custody arrangements challenging. However, it is still important that the child maintain a relationship with each parent, so creativity may be necessary. With my experience, I know how to craft workable parenting plans in these challenging situations.

Military divorces can also become complex with regard to the division of military pensions and other retirement benefits. Military retirement benefits are subject to property division in divorce. If you are the civilian spouse, a qualified domestic relations order (QDRO) will have to be prepared so that you may begin to receive your portion of the military retirement. It is not enough to simply list the division of military retirement benefits in the final decree. There are specific laws that dictate how those benefits are to be divided, so it is critical that you choose an attorney who understands the applicable laws.

I am well-versed in all laws that impact military divorce, including the Servicemembers Civil Relief Act, formerly known as the Soldiers’ and Sailors’ Civil Relief Act. This law in particular provides protections for the people who are actively serving our country. It plays a role in when and how a divorce can be filed when one spouse is on active duty, among other things.
