Is everything split 50/50 in a divorce in Texas?

When facing a divorce, one of the most common questions is whether the spouses split everything 50/50. While Texas is a community property state, the division of assets isn’t always as straightforward as a simple 50/50 split.

Understanding community property

Community property includes assets and debts acquired during the marriage. This can include income, real estate, vehicles, and even retirement accounts. There are exceptions, such as property acquired before the marriage, inheritances, and gifts. These are separate properties and are typically not subject to division.

The role of equitable distribution

Although Texas law presumes that the division of community property should be equal, the courts often apply a principle known as “equitable distribution.” This means that the division of assets should be fair, but not necessarily equal. The court considers various factors. These include each spouse’s earning capacity, education, health, and future needs, as well as any fault in the marriage’s breakdown.

When dividing assets, the court may award a larger share of the assets to the spouse in greater need. Additionally, the court may consider the contributions of each spouse to the marriage, including non-economic contributions like homemaking and child-rearing.

The goal is to achieve a fair outcome that considers the unique circumstances of both parties.
